1. Acceptance of Terms
By accessing or using MergeCore ("the Service"), including the mergecore.net website and the MergeCore desktop application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.
These Terms constitute a legally binding agreement between you ("User", "you") and MergeCore ("we", "our", "us").
2. Description of Service
MergeCore is a subscription-based software platform that provides automated script update management for FiveM servers. The Service includes:
- A desktop application for scanning, updating, and managing FiveM server resources
- A web-based API for subscription verification, update delivery, and developer tools
- A developer portal for script publishers to manage manifests and changelogs
MergeCore does not host, distribute, or redistribute third-party scripts. All updates are delivered through verified developer manifests and authorized channels.
3. Subscription & Payment
3.1 Subscription Tiers
MergeCore offers the following subscription plans, billed monthly through Patreon:
- MergeCore Premium — €5/month
- MergeCore Standard — €10/month
Features and limits for each tier are described on our Patreon page and may be updated from time to time.
3.2 Billing
All payments are processed through Patreon. By subscribing, you also agree to Patreon's Terms of Use. We do not directly process or store payment information.
3.3 Cancellation & Refunds
You may cancel your subscription at any time through Patreon. Upon cancellation, you retain access until the end of your current billing period. Refunds are handled according to Patreon's refund policy.
4. License & Usage
4.1 License Grant
Upon subscribing, we grant you a limited, non-exclusive, non-transferable, revocable license to use the MergeCore desktop application on a single device for the duration of your active subscription.
4.2 Device Binding
Your license is bound to a single hardware device via a unique hardware identifier (HWID). You may request an HWID reset by contacting support if you change your computer or hardware.
4.3 Restrictions
You agree NOT to:
- Share, resell, sublicense, or transfer your subscription or credentials to any third party
- Attempt to circumvent HWID binding, license checks, or any security measures
- Reverse engineer, decompile, disassemble, or modify the MergeCore application
- Use the Service to distribute pirated, stolen, or unauthorized scripts
- Use the Service in any way that violates applicable laws or third-party rights
- Automate access to the API beyond normal application usage
5. Developer Partners
Script developers who participate in the MergeCore Partner Program agree to additional terms:
- All scripts registered must be legitimately owned and authorized for distribution by the developer
- Developers are responsible for the accuracy and safety of their update manifests
- MergeCore reserves the right to remove any script or partner that violates these Terms or engages in harmful practices
- Partner applications are subject to approval at our sole discretion
6. Intellectual Property
The MergeCore application, website, branding, documentation, and all related materials are the intellectual property of MergeCore. You may not copy, reproduce, or create derivative works without our written permission.
Scripts managed through MergeCore remain the intellectual property of their respective developers. MergeCore does not claim ownership of any third-party scripts.
7. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that:
- The Service will be uninterrupted, error-free, or secure
- Updates applied through MergeCore will be free of bugs or conflicts
- The Service will be compatible with all server configurations
8. Limitation of Liability
To the maximum extent permitted by applicable law, MergeCore shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, server downtime, lost profits, or business interruption, arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you paid to MergeCore in the three (3) months preceding the claim.
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, including but not limited to:
- Violation of these Terms
- Fraudulent or abusive activity
- Sharing or reselling your license
- Attempting to circumvent security measures
Upon termination, your license to use the desktop application is immediately revoked. You remain responsible for any outstanding payments.
10. Modifications
We may modify these Terms at any time. Material changes will be communicated through our website or Discord. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Montenegro. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if necessary, through the competent courts of Montenegro.
